How Do Cases Usually Proceed?
The exact way the case flows through the system can vary based on different factors. The judge on the case, the type of offense, and other criteria can cause some changes to the process. However, the basics are usually the same in each case. Knowing them will help to eliminate surprises.

The first step is the grand jury phase. During this time, the jury can indict you if they conclude there is probable cause to believe you committed a felony offense. If you are indicted, you will then move on to the arraignment, when you will plead guilty, no contest, or not guilty. If you plead not guilty, you move to the pretrial phase, followed by the motion hearing (if there were motions filed regarding legal issues). You then proceed to the trial. The judge or jury will hear the case presented by the prosecutor and the defendant. If there if a verdict of guilty, or if there is a guilty plea, you then move on to the sentencing hearing so the judge can determine the punishment.
