Court Process in the Upper Sandusky Municipal Court
Arraignment. The first hearing for a criminal or traffic case is an arraignment. When you arrive at the courthouse, sign-in at the Clerk’s office and then go into the courtroom when directed. In the courtroom, you will be advised of your rights and asked to enter a plea. You may enter a plea of Guilty, Not Guilty, No Contest, or Not Guilty by Reason of Insanity. The different pleas will be described in court and are also described on the court’s website.

Pretrial. For first-degree misdemeanors (including OVI) and second-degree misdemeanors not resolved at the arraignment, the next court appearance is a pretrial. Lesser offenses proceed directly to trial. At the pretrial, the parties discuss the case, negotiate, and complete a pretrial memorandum. If the parties reach a plea agreement, the agreement is finalized before the judge. If the parties do not reach a plea agreement, the case is scheduled for a trial.

Motion Hearing. Before the trial, a party may file a motion asking the court to take certain action, such as excluding evidence. If such a motion is filed, the court holds a motion hearing to hear evidence and make a decision on the motion. The parties may also finalize a plea agreement at the motion hearing.

Trial: If the case is not resolved at the pretrial or motion hearing, it is scheduled for a trial. At the trial, the judge or jury decides whether the evidence proves the defendant’s guilt beyond a reasonable doubt.

Sentencing: If a defendant pleads Guilty/No Contest to an offense or is found guilty of an offense at trial, the court holds a sentence hearing. The sentence hearing may be on the same day as the guilty finding or may be held on a later date. At the sentence hearing, the judge hears recommendations from the parties and imposes the sentence.
