For the Hilliard Mayor’s Court, the judicial officer is a magistrate. Most often, the magistrate is attorney Mark Weaver, and there are other local attorneys and retired judges that fill-in as magistrates as well. The Mayor’s Court is located in the Joint Safety Services Building at 5171 Northwest Parkway in Hilliard, Ohio. Hearings are held every Wednesday at 8:00 am, and court personnel is available before hearings beginning at 7:30 am. When you arrive for court, you should sign-in at the front desk and be seated in the hearing room or the overflow room. The court personnel will play a video explaining your rights and the court process.
The Court Process
The first hearing for your case is an arraignment and is designed to give you the opportunity to enter a plea. You should think through your options and decide what plea you intend to enter. Your options are Guilty, No Contest, and Not Guilty. If you plead Guilty or No Contest, you will likely be sentenced, and the case will be concluded at the arraignment. If you plead Not Guilty, the case will not be concluded at the arraignment and instead will be scheduled for a pretrial hearing. If your case is not concluded by agreement at the pretrial hearing, it will be scheduled for a trial. At the trial, the prosecution has the burden of proving your guilt beyond a reasonable doubt. If your guilt is proven, you will be sentenced at that time. If your guilt is not proven, you will be found Not Guilty.
Transferring Your Case To The Franklin County Municipal Court
Because the Hilliard Mayor’s Court is not a ‘court of record’, you have the right to transfer your case. You also have the right to appeal the decision in the Hilliard Mayor’s Court and re-start the case in a Municipal Court. If you transfer the case or file an appeal, your case will be moved to the Franklin County Municipal Court. Transferring a case is a strategic decision which should probably be discussed with a lawyer.
