In this courthouse, there is one judge, Judge Mike Grigsby, and he has been on the bench since 1999. Case Process In The Marysville Municipal Court
The first step of the process for criminal and DUI / OVI cases is the arraignment. At the arraignment, you will be given the choice of pleading guilty, no contest, or not guilty. If you plead guilty or no contest, you will likely be sentenced at the arraignment. You should expect to begin serving the sentence that day, including paying any fine and beginning any jail sentence. If you plead guilty at the arraignment, you will not have the opportunity to see the evidence against you and defend yourself against the accusation.
After the arraignment is a discovery conference, at which time the defense and the prosecution exchange discovery (evidence each side intends to introduce if there is a trial). Next is a combination of a pretrial hearing and motion hearing. The pretrial hearing is for negotiating with the prosecutor for a plea bargain. If there is a plea agreement reached, it is finalized in front of the judge. If there is not an agreement reached, there is an evidentiary hearing on any motions that have been filed.
If the case is not resolved at this pretrial/motion hearing, it proceeds to a trial. At the trial, you are presumed innocent, and the prosecution has to prove your guilt to the jury or judge. You have the opportunity to cross-examine the prosecution witnesses and call your own witnesses. If you are found not guilty, you are acquitted, and the case is over. If you are found guilty, the judge will hold a sentence hearing and announce your sentence, probably on the same day.
