The Court Process For A Typical Felony Case
All cases are different, but the way they go through Union County Common Pleas Court is generally the same. As the court sees felony cases, the first step is generally the grand jury hearing. In that hearing, the grand jury will decide whether there is probable cause to believe you committed a felony. If the answer is ‘yes’, the grand jury issues an indictment to notify you that you have been charged. After receiving your indictment, you will attend an arraignment. At the arraignment, you will plead either guilty, not guilty or no contest. Your case is then scheduled for a status conference. Before the status conference, your attorney should obtain discovery from the prosecutor and provide the prosecutor with reciprocal discovery.
At the status conference, you will decide whether the case is scheduled for a plea hearing or a trial. You would choose a plea hearing if you intend to plead guilty, and you would choose a trial if you want the prosecutor to try to prove your guilt. If you choose to have a trial and file any motions regarding legal issues, there will be a motion hearing before the trial. During the trial, the prosecution will present evidence to prove your guilt. You do not have to prove your innocence, but you can question the prosecutor’s witnesses and present your own evidence if you choose to do so. At the conclusion of the trial, the jury will issue a verdict of guilty or not guilty. If you are found guilty of something, or if you had entered a guilty plea at a plea hearing, the court will hold a sentencing hearing to determine what will be the sentence.
