The court holds session on Thursdays beginning at noon. The magistrates preside over the various hearings, including arraignments, pretrial hearings, motion hearings, trials, financial hearings, and probation revocation hearings.
Court Personnel
The judicial officer of the mayor’s court is the Mayor of Upper Arlington. However, the mayor typically has magistrates who actually preside in the mayor’s court. The Clerk of Court maintains the court files for each case and collects payments for fines and court costs. For tickets that do not require a court appearance, the ticket waiver is paid at the Clerk of Court office. The city attorney has the responsibility for prosecuting the cases in the mayor’s court, and that office also prosecutes cases which are transferred from the mayor’s court to the Franklin County Municipal Court.
The Basic Court Process
When you first go to court, you will have an arraignment. The magistrate will explain the charges against you and the rights you have. You will then enter a plea of guilty, no contest, or not guilty. It’s important to remember the arraignment is not the trial; you will not be presenting evidence about the facts of the case, just entering a plea. If you plead guilty, the magistrate will impose a sentence, and the case will be done. If you plead not guilty, they will set up a date and time for a pretrial hearing. If your case is not finished at the pretrial hearing, you may have a motion hearing on legal issues and a trial to determine if your guilt was proven.
Transferring And Appealing Your Case
The Upper Arlington Mayor’s Court is not a court of record, so you have the right to transfer your case, if you want, to the Franklin County Municipal Court. For some situations, this makes sense. For other situations, it makes more sense to leave your case in the mayor’s court. If you keep your case in the mayor’s court and are not satisfied with the outcome, you can appeal to the Franklin County Municipal court. You should probably speak with an attorney about the pros and cons of transferring and/or appealing your case.
