Case Process In The Franklin County Common Pleas Court
The precise process for each case varies, depending in part on the judge assigned to the case and depending on how soon in the process the case is resolved. In general, there are typically five or six stages to the process. Each case begins at the grand jury stage. If a grand jury concludes you probably committed a felony offense, an indictment is issued to notify you that you have been charged with that offense. You then appear at an arraignment where you enter a plea (guilty, no contest, or not guilty) and the judge determines bail.
After exchanging evidence with the prosecuting attorney (discovery), the next hearing is usually a pretrial hearing for the attorneys to discuss the case and negotiate. If there have been motions filed, the next stage is a motion hearing for the judge to decide disputed legal issues. If no agreement has been reached regarding the outcome of the case, there will be a trial. At the trial, a jury or judge will determine whether the evidence proves your guilt. If you are found guilty of something, or if you plead guilty to something, the final stage is a sentence hearing for the judge to impose a sentence for the offense.
