The types of cases that can go through the court run the gamut. The court hears many types of criminal cases, as well as civil cases with damages greater than $15,000. For criminal cases, the court deals only with felony offenses (and misdemeanors charged in the same indictment as felonies). It takes many people to keep the court running smoothly, including the Clerk of Courts. The Clerk of Courts takes care of court orders and all legal documents filed with the court. If you need to see a court file for a case, the Clerk’s office is the place to do it. The clerk also receives payments to the court for fines and court costs. Other personnel in the court include the judge, the judge’s bailiff and administrative assistants, and the prosecutors. The prosecutors handling cases in this court are assistant prosecutors employed by the elected Knox County Prosecuting Attorney.
How Does a Felony Case Proceed?
While all cases are slightly different, they tend to follow the same pattern and go through the same phases. A case starts with the grand jury phase. If the grand jury determines you probably committed an offense, it issues an indictment charging you with that crime. If you receive an indictment, you will also receive a summons to appear in court (unless there was a warrant issued for your arrest). In court, you will first go to an arraignment, where you can plead guilty, not guilty, or no contest. If you plead not guilty, you then go through a pretrial hearing, a possible motion hearing for legal issues, and either a plea hearing or a trial. If you elect to have a trial, a jury or judge will determine whether the prosecutor proved you are guilty.
