How Do Cases Proceed?
Most people facing felony charges are curious as to how their case will proceed in court. While each court varies somewhat based on the case and the judge, most felony cases go through the same process. First is the grand jury hearing, and the grand jury decides if there is enough evidence to charge you with a crime. If so, you are ‘indicted’, and you receive a copy of the indictment telling you that you were charged with the offense(s). The indictment is delivered to you with a summons to appear in court (unless you were arrested). That first appearance in court is an arraignment, where you plead guilty, no contest, or not guilty. If your plea is not guilty, there will be a pretrial hearing (negotiations), a motion hearing (legal issues), and a plea hearing or a trial. During the trial, the prosecution must prove your guilt; you do not need to prove your innocence. When the trial concludes, the judge or the jury will determine whether you are guilty or not. If you are found guilty, or if you chose to plead guilty, the case proceeds to a sentence hearing. At the sentencing, you will find out your punishment from the judge. If you are found Not Guilty, the case is over, and there is no punishment.
