Basic Process In The Morrow County Municipal Court
It is important to keep in mind that different cases may follow different paths: what is discussed here is simply the most common path that cases progress through the court system. To be sure of the exact process in the Morrow County Municipal Court, you can read the court’s Local Rules.
Court sessions generally begin at 9:00 am and at 1:00 pm. The Municipal Court is located in the lower level (basement) of the courthouse. When you enter the door to the building, you should check-in at the Clerk of Court office which is straight ahead. You should then wait for your case to be called by the bailiff.
The first time you appear in the Morrow County Municipal Court is your arraignment. During the arraignment, you will be asked to enter a plea. You have three choices – no contest, guilty, or not guilty. This choice is very important, so you should know how you’re going to plead before you go to court. If you choose to plead guilty or no contest, you will likely be sentenced and finish the case at that time.
If you plead not guilty, you will return to court for a pretrial hearing. At that time, you or your attorney will negotiate with prosecutor and may reach a plea agreement. If no plea bargain is made and there are motions pending, you will have a motion hearing for the judge to decide outstanding legal issues. Then, if you still have not reached an agreement with the prosecuting attorney, you will have a trial. After your trial, you will be found either guilty or not guilty. If the judge or jury finds you guilty, you will then have to go through sentencing. At the sentencing, the judge will let you know what punishment you will receive.
