The DUI / OVI Court Process
At the first court appearance, the arraignment, you will be asked to enter a plea: guilty, no contest, or not guilty. At or before that time, you can also challenge the Administrative License Suspension. A few weeks after the arraignment, there is a pretrial hearing: an opportunity to negotiate and agreed resolution with the prosecuting attorney. If an agreed resolution is not achieved, there may be a motion hearing for the judge to make decisions about admissibility of evidence. If an agreement still is not reached, there is a trial, and either a judge or jury will decide whether the evidence proves your guilt. If you are found guilty, or if you plead guilty, there will be a sentence hearing for the judge to determine the sentence.
